Terms of Service

1. DEFINITIONS
Platform: The website or application operated by Vndor.
Customer: Any individual or entity who uses the Platform to find, book, and pay for services.
Service Provider: Any individual or entity offering services through the Platform.
Services: Any services provided by Service Providers to Customers, including but not limited to beauty, healthcare, construction, renovations, or any other category permitted on the Platform.
2. ELIGIBILITY
Users must be 18 years or older and legally capable of entering into binding contracts.
Service Providers must be legally permitted and qualified to perform the services they offer and comply with all licensing, health, safety, and industry-specific regulations.
3. PLATFORM ROLE
Vndor is a facilitator and digital marketplace that connects Customers with independent Service Providers.
Vndor does not employ, manage, or directly control Service Providers and is not responsible for their conduct, performance, or compliance.
While Vndor may conduct basic vetting or verification, it does not guarantee the accuracy, legitimacy, or quality of services offered.
Customers are responsible for performing their own due diligence.
Service Providers are independent contractors, not employees or agents of Vndor. Nothing in these Terms creates a partnership or joint venture.
Vndor does not guarantee visibility, promotion, or availability of any Service Provider. Listings and search results may be determined algorithmically.
4. BOOKINGS AND PAYMENTS
All transactions between Customers and Service Providers must occur through the Platform’s secure payment system.
Vndor may hold funds in escrow temporarily for fraud prevention, disputes, or compliance.
Service Providers are solely responsible for reporting and paying all applicable taxes (e.g., VAT, income tax) to the relevant authorities.
Customers may incur VAT or statutory taxes as part of the transaction.
Vndor is not responsible for the tax obligations of any party.
Users are responsible for verifying booking details (e.g., time, location, service) before confirming.
Vndor reserves the right to reverse, withhold, or reclaim payments in cases of fraud or policy violations.
5. USER CONDUCT
Users agree not to:
- Provide false, fraudulent, or misleading information.
- Harass, abuse, threaten, or exploit any person.
- Use the Platform for unlawful, harmful, or exploitative activities.
- Circumvent payment mechanisms or solicit off-platform arrangements.
- Impersonate others or create fake or duplicate accounts.
- Upload malicious software or interfere with Platform operations.
- Violate any applicable laws or regulations.
6. RISK AND LIABILITY DISCLAIMER
Customers acknowledge the risks of inviting Service Providers into homes or physical spaces; Vndor is not liable for damage, injury, theft, or loss.
Service Providers acknowledge similar risks when working in private or unfamiliar environments.
Vndor disclaims all warranties regarding services offered via the Platform.
7. BACKGROUND CHECKS AND VERIFICATION
Vndor takes reasonable steps to verify Service Providers’ identity and credentials but cannot guarantee their legitimacy or performance.
Users must exercise personal judgment, especially when arranging in-person services.
8. CANCELLATIONS, REFUNDS & DISPUTE RESOLUTION
Service Providers are responsible for their own cancellation and refund policies.
In disputes, Vndor acts as a neutral party and may resolve issues using transaction history.
Vndor may process compensation/refunds via its payment processor, and users authorize such interventions.
9. INDEMNITY
Customers and Service Providers agree to indemnify and hold harmless Vndor from:
- Any breach of these Terms, applicable law, or third-party rights.
- Any acts or omissions during service delivery.
- Any misuse of the Platform or unlawful conduct.
10. PRIVACY AND POPIA COMPLIANCE
Vndor processes personal data in line with POPIA regulations.
Users can access, correct, or request deletion of their data by emailing: privacy@vndor.co.za
11. TERMINATION
Vndor may suspend or ban users who violate terms or endanger platform safety.
Users can request account deletion, but some data may be retained for legal or operational reasons.
12. LIMITATION OF LIABILITY
Vndor is not liable for indirect, incidental, punitive, or consequential damages.
Vndor’s total liability is limited to:
- The amount paid by the user in the past 6 months, or
- R10,000 — whichever is lower.
13. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of South Africa.
Disputes shall be resolved in the courts of South Africa.
